{"id":30525,"date":"2019-02-11T14:18:51","date_gmt":"2019-02-11T14:18:51","guid":{"rendered":"https:\/\/conseil-concurrence.preprod.io\/qui-sommes-nous-2\/missions-et-attributions\/"},"modified":"2026-04-07T12:22:21","modified_gmt":"2026-04-07T12:22:21","slug":"missions-and-responsibilities","status":"publish","type":"page","link":"https:\/\/conseil-concurrence.ma\/en\/who-are-we\/missions-and-responsibilities\/","title":{"rendered":"Missions and Responsibilities"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<p style=\"text-align: justify;\">Pursuant to the provisions of Article 166 of the Constitution, the Competition Council is an independent institution responsible, within the framework of promoting free and fair competition, for ensuring transparency and fairness in economic relations, particularly through the analysis and regulation of market competition and the control of anticompetitive practices, unfair commercial practices, and economic concentrations and monopolies.<\/p>\n<p style=\"text-align: justify;\">The Council has legal personality and financial autonomy.<\/p>\n<p style=\"text-align: justify;\">The Council has decision-making powers in fighting anticompetitive practices and reviewing merger transactions, as defined in the Law on Free Pricing and Competition.<\/p>\n<p style=\"text-align: justify;\">It is also called upon to issue opinions on consultation requests, as stipulated in Law N\u00b0 20-13 and Law N\u00b0 104-12 on Free Pricing and Competition, and to publish studies on the overall competitive environment at both sectoral and national levels.<\/p>\n<p style=\"text-align: justify;\">The Council may be referred matters relating to anticompetitive practices by undertakings or, in relation to matters falling within their remit, by the bodies referred to in the last paragraph of Article 5 of Law N\u00b0 20-13.<\/p>\n<p style=\"text-align: justify;\">It may also be referred by the Government regarding any anticompetitive practice or conduct likely to constitute such a practice, as well as breaches of commitments undertaken by the parties to a merger transaction.<\/p>\n<p style=\"text-align: justify;\">The Council may initiate proceedings on its own initiative in respect of any practices liable to affect free competition.<\/p>\n<p style=\"text-align: justify;\">Furthermore, it may also initiate proceedings on its own initiative regarding breaches of commitments undertaken by the parties to a merger transaction, where the Government has exercised its power to review the decision on the said transaction. These proceedings also involve cases of failure to comply with the rules set out in the Law on Free Pricing and Competition, regarding the notification of mergers and acquisitions and compliance with the Council and the Government\u2019s decisions on such transactions.<\/p>\n<p style=\"text-align: justify;\">The council may take the initiative to issue an opinion on any competition matter.<\/p>\n<p style=\"text-align: justify;\">It may also recommend that the Government implement the necessary measures to ensure the functioning of market competition.<\/p>\n<p style=\"text-align: justify;\">The Government shall notify the Council of the measures taken or to be taken to implementation its recommendations.<\/p>\n<p style=\"text-align: justify;\">The Council can be consulted by the Parliament\u2019s standing committees on draft legislation, as well as on any other competition matter, in accordance with the rules of procedure of the two Houses of Parliament.<\/p>\n<p style=\"text-align: justify;\">It shall issue opinions on any competition matter at the request of the Government.<\/p>\n<p style=\"text-align: justify;\">In addition, it may also issue opinions, on any competition principle, at the request of certain bodies acting within the scope of their respective mandates. These include the councils of territorial authorities, chambers of commerce, industry and services, chambers of agriculture, chambers of crafts, chambers of maritime fisheries, trade unions and professional organizations, sectoral regulatory bodies, and public-interest consumer associations.<\/p>\n<p style=\"text-align: justify;\">Meanwhile, the Council may be consulted by courts in relation to anticompetitive practices identified in the cases before them. It may issue an opinion only after adversarial proceedings have been conducted. However, where it already holds information gathered during earlier proceedings concerning the same practice, it may issue its opinion without implementing the procedure provided for by said law.<\/p>\n<p style=\"text-align: justify;\">The Government must consult the Council on any draft legislation or regulations that establish a new regime or amend an existing one with the direct effect of:<\/p>\n<p style=\"text-align: justify;\">1 \u2013 Subjecting the exercise of a profession or access to a market to quantitative restrictions,<\/p>\n<p style=\"text-align: justify;\">2 &#8211; Establishing monopolies or other exclusive or special rights in the territory of Morocco or in a substantial part thereof,<\/p>\n<p style=\"text-align: justify;\">3 &#8211; Imposing uniform practices in relation to prices of conditions of sale,<\/p>\n<p style=\"text-align: justify;\">4 &#8211; Granting state aid or aid from territorial authorities in accordance with the relevant legislation.<\/p>\n<p style=\"text-align: justify;\">The Council shall seek the opinion of the relevant sectoral regulatory bodies on competition issues falling within their remit.<\/p>\n<p style=\"text-align: justify;\">Where appropriate, it may call upon their expertise and qualifications for investigation and inquiry purposes, under a conventional setting.<\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][tm_spacer size=&#8221;lg:80&#8243;][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column][vc_column_text] In accordance with the provisions of Article 166 of the Constitution, the Competition Council is an independent institution responsible, within the framework of organizing free and fair competition, for ensuring transparency and fairness in economic relationships, notably through the analysis and regulation of competition in markets, the control of anti-competitive practices, unfair commercial practices, and economic concentration and monopoly operations.
