In accordance with the provisions of Article 14 of Law 20-13 concerning the Competition Council, the Permanent Commission of the Council held a meeting on Monday, December 12, 2022 at 9:30 am, under the chairmanship of Mr. Ahmed Rahhou, President of the Competition Council, to examine the files submitted to it by the Council’s investigation services.
At the beginning of its work, the Permanent Commission approved the minutes of its meeting held on December 8, 2022.
The Permanent Commission then made decisions to authorize the following three economic concentration operations:

- The acquisition by the investment fund « CAPMEZZANINE III » of 44.9% of the share capital and voting rights of the company « Comaner Distribution SARL »
- The acquisition of exclusive control of the company « Savola Morocco SA » by the company « Zine Capital Invest SA », through the acquisition of 100% of its share capital and associated voting rights
- The acquisition by « Electricité de France SA » of the exclusive control of certain activities of the company « GE Steam Power » from the company « General Electric Company »
- The acquisition of exclusive control of the company « TOTAL Mauritanie SA » by the company « AKWA Africa SA » through the acquisition of 100% of its share capital and related voting rights
The Permanent Commission subsequently noted that the economic concentration operation concerning the merger between the companies « ST Microelectronics SAS » and « Electronic Holding SAS » does not fall within the scope defined by Article 11 of Law 104-12 on freedom of prices and competition.
