In accordance with the provisions of Article 21 of Law No. 20-13 on the Competition Council, as amended and supplemented, the Competition Council may issue and publish guidelines to explain and detail the modalities of application of certain legal and regulatory provisions governing competition.
In this context, the Competition Council has developed a draft of guidelines on horizontal cooperation agreements between competitors. The purpose of this project is to provide economic operators and various interested parties with a clear and transparent analytical framework, specifying the principles for assessing the compliance of these agreements with the provisions of Law No. 104-12 on price freedom and competition, as amended and supplemented, particularly with regard to their purpose, effects, and the exemption conditions provided for by this law.
These guidelines cover certain forms of cooperation, particularly joint purchasing agreements and the pooling of storage infrastructures.
To this end, a public consultation is launched to gather comments and observations from the various stakeholders, until November 09, 2026.
Comments and observations can be sent to the following email address: secretariat.general@conseil-concurrence.ma.
