Guidelines on the transaction procedure provided for in Article 37 of Law No. 104-12 on price freedom and competition as amended and supplemented

“In accordance with the provisions of Article 21 of Law No. 20-13 on the Competition Council, as amended and supplemented, the Competition Council may issue and publish guidelines to explain and detail the modalities of application of certain legal and regulatory provisions governing competition.

Within this framework, a draft of guidelines relating to the procedure for the application of the provisions of Article 37 of Law No. 104-12 on price freedom and competition as amended and supplemented, called ‘the transaction procedure’. This project aims to provide companies and organizations wishing to benefit from this procedure with a clear and transparent framework explaining the purposes, conditions, modalities, and the procedure for its implementation.

To this end, a public consultation is launched to gather comments and observations from the various stakeholders, until May 28, 2024.
