The Permanent Commission of the Competition Council held its meeting at the Council’s headquarters on Monday, August 10, 2020 at 09:30, under the chairmanship of Mr. Driss Guerraoui, President of the Council.
After a thorough examination of the items on the agenda of this meeting, the Permanent Commission made decisions to authorize three economic concentration operations, as they have no impact on competition in the relevant markets. These are the following operations:

- The exclusive control by the company “GarlandLaidley SGPS” of the shares of the capital and voting rights pertaining to the companies “Adatra SARL”, “Casalis SARL”, and “Cerex SARL”;
- The acquisition of assets of the company “Alshaya Morocco S.A.S” by the company “Nestlé Maroc SA”;
- The exclusive control by the company “OMV Aktiengesellschaft” of the company “Borealis AG”.

The Permanent Commission also examined the submission of the company “Mylan Pharmaceuticals S.A.S” regarding the compliance of the tender for the purchase of drugs for oncology centers of the Ministry of Health with the rules of fair competition. The Permanent Commission considered that the Competition Council is not competent to handle this submission, as the facts alleged do not fall within the Council’s jurisdiction.
The Permanent Commission had previously approved the minutes of its meeting held on July 13, 2020.
