Press release from the Competition Council regarding the economic concentration project concerning the acquisition of exclusive control by the company “Amcor Plc” of the company “Berry Global Group Inc.” through the merger between the latter and the subsidiary of the acquirer, the company “Aurora Spirit Inc.”

In accordance with Article 13 of Law No. 104-12 on freedom of prices and competition and Article 10 of Decree No. 2-14-652 adopted for its implementation, as amended and supplemented, the Competition Council makes available to the public the “summary of the operation” below, containing the information provided by the parties.

The Competition Council received notification of an economic concentration operation concerning the acquisition of exclusive control by the company “Amcor Plc.” of the company “Berry Global Group Inc.” through the merger of the latter with the company “Aurora Spirit Inc.”, a subsidiary wholly owned by the company “Amcor Plc.”

“Amcor Plc.” is a US company headquartered in the State of Jersey, registered in the commercial register under number 001-38932. It is active in the manufacturing and supply of sustainable packaging solutions, offering a wide range of packaging products for the food, beverage, medical, pharmaceutical, household hygiene, personal care, and other industries.

“Berry Global Group Inc.” is a US company headquartered in the State of Delaware, registered in the commercial register under number 001-35672. It is active in the manufacturing and supply of a wide range of packaging products.

“Aurora Spirit Inc.” is a US company headquartered in the State of Delaware, a subsidiary wholly owned by the company “Amcor Plc.”, which will be tasked with merging with the company “Berry Global Group Inc.”.
