Press release from the Competition Council regarding the economic concentration project related to the merger between the company “Akzo Nobel N.V.” and the company “Axalta Coating Systems Ltd.”

The Competition Council and the Higher Council of the Judiciary (CSPJ) jointly organized a training workshop for magistrates in June 2022, as part of the joint cooperation program aimed at realizing the complementarity between the two institutions in the field of exchanging expertise; the goal being to ensure a sound interpretation and proper application of legislative texts related to competition in markets.

Although the Competition Council is the constitutional body responsible for enforcing competition law and ensuring compliance with its rules in markets, the final decision rests with the judiciary, as with any law. Council decisions are subject to judicial review before the Rabat Court of Appeal for anticompetitive practices and before the administrative chamber of the Court of Cassation for economic concentrations.

During this training, specialized judges had the opportunity to exchange views with their European counterparts as well as with experts from the World Bank Group and UNCTAD. The objective was to examine certain issues related to procedural aspects, appeals, judicial control, investigative powers, and defense system in matters of non-competitive practices and economic concentrations.
