The Permanent Commission of the Competition Council held a meeting on Thursday, December 12, 2019. This meeting was dedicated to the examination and adoption of decisions related to three economic concentration projects.
The first project concerns the acquisition by the company “CB Holding SARL” of all the share capital and voting rights of the company “Delma d’investissements touristiques”, the second relates to the acquisition by “la Société Foncière KMR” of all the shares and voting rights of the company “Union Maroc Emirats for Tourism (UMET)” and the third project concerns the acquisition of the activities and assets of polyamides and technical plastics of the Belgian company “Solvay SA” by “la Société BASF”, consisting of production units operating in France, Germany, Brazil, Mexico, South Korea, China, and India.
During this meeting, the Permanent Commission also declared the inadmissibility of the submission regarding the sale price of lubricants, coming from the National Federation of Fuel Merchants in Morocco, as the facts alleged are not supported by sufficiently probative evidence, in accordance with the provisions of Article 26 of Law 104-12 on price freedom and competition.
The Permanent Commission also decided on the inadmissibility of the submission from the Southern Federation of Consumer Protection Associations regarding a possible agreement in the photography sector.
