In accordance with the provisions of Article 14 of Law 20-13 relating to the Competition Council, the Permanent Commission of the Council held a meeting on Monday, November 7, 2022 at 09:30, under the chairmanship of Mr. Ahmed Rahhou, President of the Competition Council, to examine the files submitted to it by the Council’s investigation services.
At the beginning of its work, the Permanent Commission approved the minutes of its meeting held on November 3, 2022.
The Permanent Commission then decided to authorize the following economic concentration operations:

- The acquisition of indirect joint control of the company ARENA PROPERTY DEVELOPMENT SA, by the companies SANAM IMMOBILIER SA, AERA CAPITAL SARL AU, and HOLBIS SARL AU, through the acquisition of 93.26% of its share capital and related voting rights;
- The joint control acquisition of the company ‘GLOBEX INVESTISSEMENT S.A’ by the company ‘AMETHIS MENA FUND II SICAV-RIF S.C.A’ through the acquisition of 30.5% of its share capital and associated voting rights;
- The acquisition by “DR. F. PORSCHE AKTIENGESELLSCHAFT” of the exclusive control of “RACEDEPARTMENT B.V.” through the acquisition of 100% of the share capital and related voting rights;
- The acquisition by the company ‘MONDI UNCOATED FINE & KRAFT PAPER GMBH’ of a production plant, located in the city of DUINO in Italy, from the ‘BURGO’ group;
- The acquisition by the company MUTARES SE & CO.KGAA of exclusive control through the acquisition of 100% of the capital and voting rights of the company FRANCE NEWCO, a subsidiary of MAGNA PT BORDEAUX SAS to be created.
Furthermore, the Permanent Commission declared the submission from the company DEFACTO RETAIL MA regarding unfair commercial practices by a store to be inadmissible.
