Press release from the Competition Council regarding the economic concentration project related to the merger between the company “Akzo Nobel N.V.” and the company “Axalta Coating Systems Ltd.”

In accordance with the provisions of Article 14 of Law 20-13 on the Competition Council, the Permanent Commission of the Council held a meeting on Monday, March 29, 2021 at 9am, under the chairmanship of Mr. Ahmed Rahhou, President of the Competition Council, to examine the files submitted to it by the Council’s investigation services.

At the beginning of its work, the Permanent Commission approved the minutes of its meeting held on March 11, 2021.

The Permanent Commission then authorized the economic concentration operation concerning the creation of a joint venture by MHP Management-und IT-Beratung GmbH and Transnet BW GmbH, considering the lack of impact of this operation on competition in the relevant national markets.

Furthermore, in accordance with the provisions of Article 26 of Law 104-12 on price freedom and competition, the Permanent Commission declared inadmissible, for lack of interest or standing, the following two submissions:

          • Requests filed by the Association of Intermediaries and Entrepreneurs in Insurance in Morocco “AIEA” regarding the competition situation in the insurance market.
          • Request from the National Association of Artisan Jewelers concerning temporary export authorizations granted by the sector’s supervisory ministries and their impact on competition.

For the third submission, emanating from the companies “Sgnr sarl” and “Noble Rest sarl” regarding the tenders launched by the Ibn Rochd University Hospital in Casablanca and the National School of Agriculture in Meknes, the Permanent Commission considered it inadmissible by considering that the facts invoked by the submitting party do not fall within the scope of the Competition Council’s competences.
