In accordance with the provisions of Article 14 of Law 20-13 concerning the Competition Council, the Permanent Commission of the Council held a meeting on Monday, September 19, 2022 at 09:30, under the chairmanship of Mr. Ahmed Rahhou, President of the Competition Council, to examine the files submitted to it by the Council’s investigation services.
At the beginning of its work, the Permanent Commission approved the minutes of its meeting held on September 15, 2022.
The Permanent Commission then decided to authorize the following economic concentration operations:

- Acquisition of indirect exclusive control of the company greenyellow S.A.S., by the company Ardian France S.A, through the acquisition of 72.04% of the share capital and voting rights related thereto;
- Acquisition by the company WALSIN LIHWA CORPORATION of indirect exclusive control of the company COGNE ACCIAI SPECIALI S.p.A. and its subsidiaries, through an acquisition vehicle;
- Creation of a joint venture by the company Vivo Energy Maroc SA and the company Total Energies Marketing Maroc SA with the purpose of constructing and operating a Liquefied Petroleum Gas (LPG) filling center in the Taroudant region;
- Acquisition of exclusive control of the company “Contabo Topco GmbH” and its subsidiaries by the company “Constellation BidCo GmbH”, an acquisition vehicle wholly owned by various subsidiaries of the company “KKR & Co. Inc”;
- Acquisition of direct exclusive control of the company “Bolloré Africa Logistics SAS”, and its direct and indirect subsidiaries involved in the operation, by the company “SAS SHIPPING AGENCIES SERVICES SARL” through the acquisition of 100% of the target’s share capital and voting rights, from the company Bolloré SE.
