The Permanent Commission of the Competition Council held its meeting via videoconference on Friday, March 20, 2020 at 10:00 am.
This meeting was dedicated to the examination and approval of three economic concentration decisions and three inadmissibility decisions submitted for the consideration of the Permanent Commission.
At the beginning of the meeting, Mr. Driss Guerraoui, President of the Competition Council, expressed his warm thanks and deep appreciation to all members, officials, and staff of the Competition Council for their voluntary contribution to the Special Fund for the management of the Covid-19 pandemic, created in accordance with the High Directives of His Majesty King Mohammed VI, may God assist him.
During this meeting, decisions were made regarding the following three economic concentration operations:

- The acquisition by the company “MM Air Limited” of 71.2% of the shares of the company “Aircastle Limited”;
- The acquisition by the company “Joint Stock Company United Chemical Company Uralchem” of all the capital of the company “Public Joint Stock Company Uralkali”;
- The merger of the company “Metso Oyj” and the company “Outotec Oyj”

As for the inadmissibility decisions taken by the Permanent Commission, they concerned:

- The two submissions regarding the tenders issued by the Ministry of Health for medications against hepatitis C and tuberculosis;
- The complaint filed by the company “Mcdomar Group s.a.r.l.” regarding the tender for the construction of the Al Hoceima hospital center (lot: medical fluids);
- The submission from the National Federation of Radiology and Medical Imaging (FNRIM) regarding possible anticompetitive practices in the relevant market

At the end of the Permanent Commission meeting, the President of the Competition Council congratulated the members of the Permanent Commission, the Secretary General, the General Reporter, and the reporter of the submission regarding the Council’s opinion request, made by the Government concerning the regulation of prices for hydroalcoholic gels and protective masks, for the efficiency, expertise, and diligence with which this request was examined and the reception it received from the national public opinion as well as from competition observers in our country.
The President of the Council also informed the commission members of the recruitment of three study officers and an investigator to strengthen the capacities of the Department responsible for Economic and Competition Legal Studies and Monitoring, as well as the postponement of the High-Level International Workshop that was scheduled to take place at the beginning of June 2020 on the National Competition Barometer.
